Interesting question - since you're liable for major damage, is it even legal to ban pets?

That is an interesting question. Damage may not be the only concern though. A loud animal might annoy other tenants, and the amount of liability the landholder faces if the pet should hurt another tenant might also be under consideration. Irresponsible pet owners who don't clean up after their pets outside might also be a factor in keeping the apartments pet-free.

These are all individual liability issues - not picking up after your pet is a violation of a by-law, a loud person can easily be just as annoying and I have a hard time believing a landlord can be held liable for the actions of a tenant's animal.
Maybe if the initial contract was signed with the stipulation, but I don't think you can impose it. You've gotta be able to get grandfathered in rather than being forced out of your home.

I'm guessing it has more to do with statistics, maybe. Like something along the lines of, People with pets are more likely to be more of a liability. There are good pet owners and there are idiot pet owners; either way, the apartments and rentals have to cover their asses and protect their properties (and its reputation) since they're kind of the moneymakers.
There was this couple that lived down the hall from us at our old apartment and they had a fairly little dog, completely within the weight and breed limitations but it yapped a lot, nipped at people, drooled all over the place and just wasn't very well trained. But these people doted on it and spoiled it and acted like its behavior wasn't absolutely atrocious.
Not all pet owners willingly discipline their animals so the properties probably bypass all of that by not allowing pets.

Well, to a certain degree, yes, the landlord IS responsible. If a tenant's animal bites someone, the landlord is dragged into it since it's THEIR property. It's no different than someone slipping and falling at the grocery store or getting injured while at your house. YOUR property, YOUR liability.

people mistake merlin for a pom pretty frequently...even though he's twice the size of one.
